Google wins long-running battle against defamatory web links

Google won a long-running legal dispute. In 2004, Google was accused of distributing libellous links.

Google denied being associated with the connection and “The Age” story that tainted George Defteros’ image. All Australians killed in high-profile gangland killings in Melbourne that year were killed. He was also charged.

The UK news reported today that Australia’s highest court denied Google’s misconduct. They argue the tech giant didn’t write, publish, or release the content.

Five of seven judges judged Google innocent of any involvement. The link just provided access to the story, they said.

The Australian High Court threw out all of Defteros’ accusations about Google’s search results to promote the narrative.

One person who clicked the link was looking for similar content, the judges said.

Some judges ruled that the case may have been reversed if the link was for sponsored content, but it wasn’t.

They also said Google’s appeal was unnecessary and didn’t need additional debate.

In 2016, Defteros sued Google for defamation. The link was withdrawn in December 2021 after losing its initial court battle.

Google was smart and quick. The corporation argued that it would be responsible for every page of content related to the connection. To avoid that, the entire web would need to be censored.

While the initial appeal in 2020 was unsuccessful, Defteros was awarded $40,000 in damages. Google wouldn’t be quiet.

It enlisted the High Court’s help in January. As you can expect, the ruling affected numerous Australian internet enterprises.

Thanks to Google, they no longer have to worry about search engine results getting them in trouble. Like with auto-generated connections, the accuser would have to show proof of intentional bad behaviour.
